PRIVACY POLICY

DMP Arena Trading Ltd (08352182) with registered address at The Northern Echo Arena, Neasham Road, Darlington, DL2 1DL (“we”, “our”, “us”) is committed to protecting and respecting the privacy of our customers. We are the data controller for the purposes of the General Data Protection Regulation (Regulation (EU) 2016/279) and any other law applicable to the processing of your personal data. We will take all necessary steps to ensure that your personal data is processed by us in accordance with these data protection laws.

This privacy notice aims to give you information on how we collect and process your personal data through your use of this website and your subsequent interactions with us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. It is important that you read this privacy notice together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy notice supplements the other notices and is not intended to override them.

COLLECTING YOUR PERSONAL INFORMATION

We will collect and process the following data about you:

Information you give us. This is information about you that you give us by filling in forms on our website, creating an account on our e-ticketing site, making a purchase with the club or by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to use our site, and when you report a problem with our site. This information that you give us may include: Identity Data, including first name, last name, username or similar identifier, title, and date of birth; Contact Data, includes billing address, delivery address, email address and telephone numbers;Financial Data, including bank account and payment card details; Transaction Data, including details about payments to and from you and other details of products and services you have purchased from us; Profile Data, including your username and password, your interests, preferences, feedback and survey responses; and
Marketing and Communications Data, including your preferences in receiving marketing from us and our third parties and your communication preferences.

With regard to each of your visits to our site we will automatically collect the following information: Technical Data, including the Internet protocol (IP) address used to connect your computer to the Internet, browser type and version, browser plug-in types and versions, operating system and platform. Usage Data about your visit, including the full Uniform Resource Locators (URL), clickstream to, through and from our site (including date and time), page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs) and methods used to browse away from the page.

We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

We do not collect any Special Categories of Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. Information we receive from other sources. This is information we receive about you if you use any of the other websites we operate or the other services we provide.

Cookies: Our site uses cookies to distinguish you from other users of our site. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site. IF YOU ARE UNDER 16

If you are under 16 and register with the club we will collect your date of birth and retain that with your name and other details you may provide. This is so we can ensure we treat you in an age appropriate way in line with this policy. For so long as you are under 16 we will not send you any marketing communications or share your details with our commercial partners. However, if you have signed up to receive a product or service we may contact you about this.

HOW WE USE YOUR PERSONAL DATA

We use information held about you in the following ways: Information you give to us. We will use this information:
to carry out our obligations arising from any contracts entered into between you and us and
to provide you with the information, products and services that you request from us;
to provide you with information about other goods and services we offer that are similar to
those that you have already browsed or enquired about;
to provide you, or permit selected third parties to provide you, with information about goods
or services we feel may interest you. If you are an existing customer, we will only contact you by electronic means (e-mail or SMS) with information about goods and services similar to those which were the subject of a previous sale to or negotiations with you. If you are a new customer, and where we permit selected third parties to use your data, we (or they) will contact you by electronic means only if you have consented to this. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data (the registration form);

Information we collect about you. We will use this information:

MARKETING

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing). You will receive marketing communications from us if you have requested information from us, purchased from us or if you provided us with your details when you entered a competition, or registered for a promotion. We will get your express opt-in consent before we share your personal data with any company outside of the club for marketing purposes.

Data policy

WHERE WE STORE YOUR PERSONAL DATA

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy. All information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

DATA RETENTION

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

SENSITIVE DATA

In order to confirm your eligibility for any Disability discount we may ask you for proof of disability. Any disability verification documents submitted will be used to verify your status and will then be deleted from our systems. No sensitive data will be retrained unless with your expressed written permission.

YOUR RIGHTS

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us. You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. In certain situations, you are entitled to: (i) request access to a copy of your personal data; (ii) request that we correct your personal data; (iii) request that we erase your personal data; (iv) object to processing of your personal data where we are relying on a legitimate interest; (v) request the restriction of processing of your personal data; (vi) request the transfer of your personal data to a third party; or (vii) where you have provided your consent to certain of our
processing activities, in certain circumstances, you may withdraw your consent at any time (but please note that we may continue to process such personal data if we have legitimate legal grounds for doing so). You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. We try to respond to all legitimate requests within one month.

Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests (in each case, where we are legally entitled to take longer to respond). TICKETING TERMS AND CONDITIONS

Darlington Mowden Park RFC (the Club) wants everyone entering the Darlington Arena to enjoy their visit and would like to inform you that the purchase of this ticket and subsequent access are subject to these terms and conditions (the Terms).

Please read these Terms carefully before you purchase any tickets from the Club. For the purpose of clarity, a ticket is any medium used to gain access to The Darlington Arena and all other locations owned, occupied or utilised by the Club for a Match (the Stadium). This includes issued paper tickets, e-tickets and print at home tickets. These Terms cover tickets issued for any rugby union game in which the Club participates and that takes place at the Stadium (each a Match).

TERMS OF ADMISSION AND TICKET RESTRICTIONS

The purchase of a ticket constitutes an acceptance by the purchaser of, and an undertaking to be bound by and observe, these Terms. As set out in more detail in Section 6 below, the Club reserves the right to refuse admission to, or eject from, the Stadium any person for behaviour likely to cause damage, injury, nuisance or annoyance or for failure to comply with these Terms, the Ground Regulations (being the ground regulations issued by the Club fromtime to time, the current version of which can be found in Schedule 1 to these Terms), the reasonable requests of the Club or for reasons of public safety.

Ticket holders and/or purchasers of tickets will be responsible for compliance and observance with these Terms and all relevant statutes, safety announcements, rules and regulations including the Ground Regulations and any reasonable instructions of the Club issued from time to time. Misconduct of the ticket holder, failing to adhere to these Terms or acting in a manner which the Club considers is detrimental to its interests or is likely in the
reasonable opinion of the Club to bring the game of Rugby or the Club into disrepute shall permit the Club to confiscate or forfeit (in each case without compensation) the ticket, prevent access to the Stadium for the fixture in question and/or ban the ticket holder from attending future Matches or other events at the Stadium for such time as the Club deems appropriate.

All Match tickets are issued subject to (i) these Terms (as may be amended, varied or changed from time to time), (ii) the rules and regulations from time to time of the RFU as the case may be having regard to the competition in respect of which tickets are offered for sale, (iii) the Ground Regulations (as such regulations may be specified and amended, varied or changed by the Club from time to time), and (iv) such additional rules and regulations as the Club may adopt from time to time, all of which are hereby incorporated into these Terms.

The Club reserves the right to price tickets and change the price of tickets for any Match however they deem appropriate before purchase by the ticket holder. Ticket sales may be
subject to a per order fulfilment fee or per ticket booking fee. The Club reserves the right to change the venue, date and kick-off of any Match without any liability whatsoever and to alter or change the programme or seating without prior notification. The Club will endeavour to make ticket holders aware of any fixture changes via e-mail but advises that the onus is on the ticket holder to check this information through official channels.

The Club reserves the right to amend the conditions from time to time in order to comply with competition regulations and legislation. The conditions apply only to the competitions in
which DMP RFC or any of its teams participates at the time of issue. You shall not offer or distribute (either free or for sale by any person) within the Stadium any consumer article or commercial product of any nature.

Ticket holders who enter the Stadium acknowledge that photographic images and/or video and/or sound recordings (and/or still images taken from video recordings) may be taken of them and may also be used in televised and/or radio coverage of Matches and/or for promotional or marketing purposes by the Club, the RFU or other third parties. By entering the Stadium ticket holders consent to photographic images and/or video and/or sound recordings (and/or still images taken from video recordings) being taken of them and used in the manner described above. CCTV is in operation at the Stadium.

No ticket holder (other than the holder of a valid licence granted by the Club or by an authority governing the game of Rugby, with the Club’s consent) may bring into, or use within, the Stadium any equipment which is capable of recording or transmitting any audio, visual or audio-visual material or any information or data in relation to a match or the stadium, other than mobile phones or like devices for personal non-commercial use. No alcohol is permitted to be brought into the Stadium.

The Darlington Arena is a non-smoking stadium; no smoking or vaping is allowed within the entire Stadium and surrounding areas (including premium facilities, suites, lounges, bars, restaurants, concourses and match seating areas); Smoking or vaping in the Stadium stands is prohibited by law. If persons wish to smoke (including Vaporizers and E-Cigarettes) they must leave the Stadium ensuring that they take their ticket with them and ensuring that in the external areas where they smoke or vape they do not obstruct entrance gates and turnstiles.

The ticket will remain the property of the Club at all times and must be produced if required to do so by an official, Pioneer, steward or employee of the Club or any member of the police. Tickets and copyright of tickets shall remain the property of the Club. If a ticket is used in breach of these Conditions, it is void (and in such case, the Club reserve the right to cancel the ticket and retain any monies paid therefore) and the ticket holder may be refused admission to or ejected from the Stadium.

2) STADIUM ADMISSION AND LOST TICKET PROCEDURE

No admission to the Stadium without a valid ticket. Concession ticket holders may be required to produce identification providing proof of age (see Section 2.7 below). There is no refund due in the event that an Adult ticket is used to admit a Concession.

3) AGE QUALIFICATIONS – PROOF OF AGE MUST BE PROVIDED

Free tickets may be offered on ticket pricing for supporters under the age of 16 on the day of the fixture. At the Club’s discretion, at any time you may be asked to provide proof of your concessionary status. Anybody found to be using concession tickets unjustly to gain entry to a Match will be liable to denied entry or ejection. No refund will be given.

All tickets must be purchased at the correct price category. If any ticket offer or reservation does not reflect the correct price for the supporter using the ticket, you must contact the club to have this corrected prior to purchase. Refunds will not be given for tickets purchased at a higher price category than is required for the ticket holder.

4) TICKET EXCHANGES AND REFUNDS – GENERAL

Tickets cannot be exchanged or refunded. Tickets are fully transferable, so if a ticket or tickets have been purchased but are no longer required, they can be passed to friends or family to be used.

5) TICKET EXCHANGES AND REFUNDS – MATCH POSTPONEMENT AND ABANDONMENT

If the Match to which a ticket relates is delayed, rescheduled or postponed for any reason, the ticket shall remain valid for the rearranged Match. It is the responsibility of the ticket holder to ascertain whether a Match for which you have a ticket has been delayed, rescheduled or postponed and any new dates and times. We cannot guarantee that you will be informed of any delay, rescheduling or postponement before the date of the Match. Any person who does
not wish to attend the rearranged Match shall be entitled to a refund of their tickets only if they contact the Box Office more than 24 hours prior to the kick off time of the rearranged Match. We are unable to refund any booking fee. In the case of a postponement this will be the full face value of the ticket for the relevant Match.

No refunds will be made if a Match is abandoned following kick-off. The Club will have no further liability whatsoever in connection with a postponed or abandoned Match, including (but not limited to) any direct or consequential loss or damage, loss of enjoyment or travel or accommodation cost. It is the responsibility of the ticket holder to ascertain the correct date and kick-off time of all fixtures.

For the avoidance of doubt, a match is deemed to be postponed only when a date confirmed by the Club or the RFU is changed. No refunds will be issued if the time of a match is changed after the date is confirmed. In the event that any Event to which the Ticket relates is played Behind Closed Doors or Partially Behind Closed Doors or is cancelled (and never played) due to the decision of the government, local council, any governing body or higher authority, Applicable Law or at the Club’s discretion due to Covid-19, the Ticket Holder acknowledges and accepts that the Club shall not be in breach of these Terms and Conditions by virtue of its inability to provide the Ticket and associated benefits in full. The Ticket Holder will be able to claim a full refund from the Club or keep the credit amount with the Club to be deducted from the purchase amount of another Ticket.

6) TICKET RESALE

Only tickets purchased through our official channels shall be valid tickets and permit entry to the Stadium. Any tickets purchased through any other resale platform shall be considered void. Tickets cannot be resold by anybody other than the official marketing selling channels of the Club or any other selling channel approved by the Club.

7) EXCLUSION OF LIABILITY

The Club excludes to the maximum extent permitted by the law any liability for loss, injury or damage to persons/property in or around the Stadium (whether or not indirect or consequential). Nothing in these Terms will exclude or restrict the Club’s liability for its own negligence.

8) REFUSAL OF PURCHASE, ENTRY OR EJECTION FROM THE STADIUM

The Club reserves the right to refuse the right to buy a ticket, entry to the Stadium and to eject from the Stadium any person:
a) who fails to comply with these Terms including the Ground Regulations;
b) who does not produce a valid ticket on request, or who holds a ticket in breach of any of the paragraphs above;
c) who supplies any false or misleading information in any form or application;
d) whose presence within the Stadium may be a source of danger, nuisance, annoyance or otherwise that may give rise to concerns in relation to the safety and security arrangements for the Match concerned. This includes, but is not limited to:
e) excessive noise;
f) smoking in non-permitted areas;
g) persistent use of foul and abusive language;
h) throwing of any object which might injure or cause damage to people or property;
i) persistent standing in a seated area, on a seat, in an aisle or gangway whilst a Match is in progress;
j) climbing over any fences or other structures without permission, or entering an area prohibited to the ticket holder;
k) exhibiting any forms of bigotry, racism or inappropriate behaviour arising from any form of prejudice. For the avoidance of doubt, anyone found in breach of this condition could receive a warning, have their ticket confiscated without compensation, receive an indefinite life ban from the Stadium and in some cases arrest;
l) exhibiting aggressive or abusive behaviour to any member of staff of the Club or a member of the police;
m) failing to comply with instructions from a Club steward or member of the police, including refusal to be searched;
n) damaging, interfering with or tampering with the Stadium or property of the Club in any way;
o) being in possession of any item that may be used as a weapon or missile which includes but is not limited to flares and smoke bombs, or any bottle, can or tin;
p) appearing to be under the influence of alcohol and/or drugs; or
q) being suspected of committing, being likely to commit or having committed in the past a criminal offence within or on the site of the Stadium.

Where any person is ejected from the Stadium due to any of the circumstances described above, no money will be refunded.

9) GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the courts of England and Wales.
